I'm Named As Trustee of My Mother's Trust, But I'm Out of State. I Need Help!


Louisiana has amended the Trust Code in Title 9 of the Louisiana Revised Statutes to enable a Trustee to appoint an agent by mandate, such that the Trustee can delegate ministerial duties to the mandatary, or duties which the Trustee cannot be reasonably expected to perform himself. Take a look at LRS 9:2087. The statute gives a nonexclusive list of items which are ministerial duties, but the trust may be drafted to include other items, or exclude items named in the statute. The flexibility this gives to a Trustee is significant, and should be considered in the tools you use in drafting, as well as being added to your setup checklist
